Terms of service
Last updated [DATE]
These terms govern your use of Site Pulse. They are written to be read, not to hide things. By using the platform you agree to them. If you are signing on behalf of an organisation, you confirm you may bind it. [Legal entity name] ("Site Pulse", "we") provides the service; "you" means the customer organisation and its users.
01 The service
Site Pulse is a permit-to-work platform for industrial sites. It digitises the permit workflow (request, review, approval, LOTO, activation and close-out) across the roles on your site, with a control-room dashboard and a mobile interface for the floor. We describe the platform on this website; the features available to you are those in your plan and order.
02 A tool, not a substitute for your safety duties
This matters most, so it comes first. Site Pulse supports your safety process and your obligations under frameworks such as the Arbowet RI&E, ISO 45001 and CSRD/ESRS S1. It does not replace them. You remain responsible for safe work, for the decisions your people make, and for your legal duties as employer and operator. The platform records and routes information; it does not authorise work, and it is no guarantee that a job is safe.
03 Accounts and access
Access follows the roles your organisation assigns. Contractors without an account can act through a single-use magic link, and those actions stay traceable and linked to the permit. You are responsible for keeping access details secure and for the actions taken under your accounts.
04 Your responsibilities
You agree to:
- Give accurate information about your site, permits and people.
- Use the platform lawfully and only for its intended purpose.
- Keep your own safety judgement: Site Pulse informs decisions, it does not make them.
- Make sure the people you give access to understand their role.
05 Pricing and payment
Pricing is per plant, not per user: a fixed monthly fee, plus a one-time setup and training fee, as set out on the pricing page and in your order. Prices exclude VAT. We invoice quarterly or annually in euros. Optional integrations are quoted separately.
06 Term and cancellation
There is no mandatory annual commitment. You can cancel per quarter. On termination we export your data (permits, LOTO procedures and audit trails) in an open format, and you keep ownership of it. Fees already paid for the current period are not refunded unless the law says otherwise.
07 Data and privacy
Your data stays yours. We process personal data as described in our privacy statement and, for the operational data inside the platform, as your processor under a data processing agreement. Hosting is in the EU region (Frankfurt).
08 Availability
We work to keep the service available and reliable, with fallbacks to mobile network and wifi on the floor and a printed-permit path when connectivity fails. We do not promise uninterrupted service, and we may carry out maintenance, giving notice where we reasonably can.
09 Liability
To the extent the law allows, Site Pulse is not liable for indirect or consequential loss, and our total liability in any twelve-month period is limited to the fees you paid in that period. Nothing in these terms limits liability that cannot be limited by law. Because Site Pulse does not replace your safety duties (see above), we are not liable for decisions made, or work carried out, on your site.
10 Intellectual property
We own the platform and its software. You own your data. Neither side uses the other's marks or content beyond what these terms allow.
11 Changes to these terms
We may update these terms. For material changes we will give customers reasonable notice. The current version always lives at site-pulse.nl/terms; continued use after a change means you accept the updated terms.
12 Governing law
Dutch law applies. Any dispute we cannot resolve together goes to the competent court in [City], the Netherlands.
